1. Acceptance of terms
These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and HOSTINGDUWINGS Ltd. ("we", "us"). By registering an account, placing an order or using the services, you confirm that you are at least 18 years old and able to enter into a contract.
2. Accounts
- You must provide accurate, current and complete registration information and keep it up to date.
- You are responsible for all activity under your account and for keeping your credentials confidential.
- You must notify us immediately of any unauthorised use of your account.
3. Services & provisioning
We provide hosting, server, network-acceleration, storage and related services as described on our website. We aim to provision services promptly after payment is confirmed. Resource limits, specifications and regional availability are as stated on the relevant product page. We may modify or improve the services provided this does not materially reduce the core functionality you purchased.
4. Fees & payment
- Fees are stated on the product and pricing pages and are billed in advance on a recurring basis unless stated otherwise.
- Accepted methods include card, bank transfer and cryptocurrency (USDT/TRX on the TRC20 network). Crypto payments are credited after on-chain confirmation.
- Invoices are due on receipt. Overdue accounts may be suspended, and services may be terminated for non-payment.
- Unless required by law, fees already paid are non-refundable except under an applicable money-back guarantee.
- Prices are exclusive of VAT where applicable; VAT is applied according to the rules of Germany, the Netherlands or Hungary as relevant.
5. Acceptable use
You agree not to use the services to host, transmit or facilitate any content or activity that is unlawful in Germany, the Netherlands, Hungary or the EU, including but not limited to: malware or phishing; unauthorised intrusion or network attacks; spam or bulk unsolicited messaging; child sexual abuse material; infringement of intellectual-property rights; or content that incites violence or hatred. We may investigate suspected violations and cooperate with law-enforcement authorities.
6. Suspension & termination
We may suspend or terminate services immediately if you breach these Terms, fail to pay, or create a security or legal risk to our network or other customers. You may cancel at any time from your dashboard or by contacting support; cancellation stops future renewals but does not entitle you to a refund of fees already incurred except where the law or a guarantee requires it.
7. Intellectual property
All software, trademarks, designs and content provided by us remain our property or that of our licensors. You retain all rights to the content and data you upload. You grant us the limited right to process your content solely to operate the services.
8. Warranties & disclaimers
Except as expressly stated in our Service Level Agreement, the services are provided "as is" and "as available" without warranties of any kind to the maximum extent permitted by law. We do not warrant that the services will be uninterrupted or error-free. Mandatory consumer-protection rights under German, Dutch and Hungarian law remain unaffected.
9. Limitation of liability
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the services is limited to the amount you paid us for the affected service in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages, or for loss of data, profits or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law, including for intent or gross negligence.
10. Indemnification
You agree to indemnify and hold us harmless from claims, damages and expenses arising from your use of the services, your content, or your breach of these Terms or applicable law.
11. Governing law & jurisdiction
These Terms are governed by the laws of the jurisdiction of our contracting entity that provides your service (Germany, the Netherlands or Hungary), without regard to conflict-of-law rules, and subject to the mandatory consumer-protection law of your country of residence within the EU. Disputes are subject to the competent courts of that jurisdiction. EU consumers may also use the European Commission's Online Dispute Resolution platform.
12. Changes to these terms
We may update these Terms from time to time. We will post the revised version with a new "last updated" date and, where changes are material, provide reasonable notice. Continued use after changes take effect constitutes acceptance.
